1. Agreement

By creating an account or using the Animatica desktop application or web services at app.animatica.ai (collectively, the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Animatica (“we”, “us”, “our”).

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to use a strong password and to notify us promptly at support@animatica.ai if you suspect unauthorized access.

4. Acceptable use

You agree not to:

• Use the Service to generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Attempt to reverse-engineer, decompile, or extract the weights or architecture of any AI model accessible through the Service.
• Circumvent usage limits, authentication, or any technical restrictions of the Service.
• Use automated scripts or bots to access the Service in a manner that exceeds reasonable human usage.
• Resell, sublicense, or redistribute the Service or access to it without our written permission.

5. Generated content

You own the output generated through your use of the Service, subject to any applicable third-party rights. You grant us a limited license to use generated content solely for the purpose of operating and improving the Service (for example, debugging errors). We do not claim ownership of your generated content.

6. Subscriptions and billing

The Service offers a free tier and a paid Pro subscription. Paid subscriptions are billed monthly through Stripe. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months. We reserve the right to change pricing with 30 days' notice.

7. Usage limits

Each plan includes a monthly generation allowance. When your allowance is exhausted, further generations are blocked until the next billing cycle. We may adjust limits as the Service evolves, with reasonable notice.

8. Availability and changes

We strive to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of material changes.

9. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. You may delete your account at any time from your account settings. Upon termination, your right to use the Service ceases and we may delete your data after a reasonable retention period.

10. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that generated content will be accurate, suitable for any particular purpose, or free from errors.

11. Limitation of liability

To the maximum extent permitted by law, Animatica shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice in the Service. Continued use after changes take effect constitutes acceptance.
